PROCESSING OF PERSONAL DATA
At the moment of placing an order, the photographer obtains the client’s personal data for processing, namely first name, last name, date of birth, permanent address, postal delivery address, email address, and phone number. The protection of this personal data is governed by Regulation (EU) 2016/679 of the European Parliament and of the Council.
These personal data are provided for the purpose of delivering services and enabling mutual communication between the photographer and the client.
ORDER
An order means the confirmation of an offer (by email, Facebook/Instagram message, or SMS) between the photographer and the client for the provision of a service.
Based on mutual agreement, the photographer will determine the most suitable available photography date for the client.
A date can be considered reserved only after receipt of the specified booking fee. Until then, the date cannot be considered reserved.
PAYMENT AND RESERVATION
An invoice for the booking fee is issued for the reservation, and after it is paid, the reservation becomes valid.
The remaining total amount for the photography is due within five working days after the date of the photographed order, payable by bank transfer.
If the selected photo package price or any additional services beyond the package are not paid, the photographer reserves the right not to deliver the work until full payment is made.
The client has the right to cancel the order no later than three months before the photography date. In such case, 25% of the booking fee will be refunded after deduction of documented and necessarily incurred costs related to any preparations already carried out by the photographer. If this three-month period is not respected, the booking fee is forfeited in full in favor of the photographer. This does not apply if both contractual parties agree otherwise.
If the client fails to attend the shoot at the agreed date and time, the client is obliged to pay compensation equal to the full price of the photography.
If the client is more than 20 minutes late without prior notice, the photographer reserves the right to cancel the shoot and leave the studio or agreed location. In this case, the photographer is entitled to payment of the full price.
PHOTO PREVIEWS
If photo previews are provided to the client, it is not permitted, without the photographer’s consent under Copyright Act No. 121/2000 Coll., to publish, share, save, screenshot, or further edit these previews in any way (they are the photographer’s property and intended solely for selection for editing).
The previews sent represent the best images from the shoot and are selected exclusively by the photographer. Their number is not fixed, but always allows sufficient choice according to the selected package.
The client shall send their selection for editing back as soon as possible, no later than one week after receipt. If the selection is sent after this period, the photographer reserves the right to extend the delivery time (see Delivery Time).
After completion of the order, the gallery with previews is deleted.
DELIVERY OF PHOTOS AND DELIVERY TIME
The standard delivery time for finished edited photographs in electronic form is 25 working days from the date of the shoot.
For orders where the client selects the photos, the 25-day period is counted from the date the selected photos for editing are paid.
The client may choose an express delivery of the electronic photos within 5 days. This option increases the total package price by CZK 4,000.
All finished edited photographs are delivered in full resolution in JPG format via an online gallery.
Delivery of unedited photographs is not provided, even by agreement.
PRINTING AND COMPLAINTS
The client must communicate any comments regarding retouching to the photographer immediately after viewing the photos, no later than three days after delivery. Later comments will not be taken into account.
Photographs are printed by a verified Czech supplier on high-quality photo paper.
Complaints regarding printed photographs are possible only in the case of visible printing defects (scratches, streaks, or other visible flaws), not regarding color tone or brightness/darkness of the print.
Dissatisfaction with the photographic style or the photographer’s artistic approach is not a valid reason for complaint.
Complaints based on color rendering of the final photographs, cropping, or the client’s different idea of editing that is entirely inconsistent with the photographer’s style are not acceptable.
Client dissatisfaction with their own appearance cannot be considered a reason for complaint.
The photographer is not liable for imperfect results caused by unsuitable weather, poor lighting conditions, or other circumstances that prevent achieving higher image quality and that could not be technically and/or artistically compensated or adjusted, nor for imperfect content if obstacles are created by the photographed persons.
Ordering photographs for editing or printing is binding – if the client waives printed photographs included in the selected package, the price is not reduced.
LIABILITY FOR DAMAGE
The client is fully responsible for any damage they cause to equipment and must compensate the damage in full, at replacement (new) value, not depreciated value.
In the case of event photography, the client is also fully responsible for damage caused to equipment by guests or staff and must compensate such damage in full, at replacement (new) value.
ARCHIVING OF PHOTOGRAPHS
Unedited previews are archived for one month from the date the selection is sent.
Edited photographs are archived by the photographer for one year and can be resent to the client electronically during this period.
CONSENT TO USE PHOTOGRAPHS
If the client does not wish their photographs to be published or used for the photographer’s presentation purposes, they must inform the photographer in writing in advance. If they do not do so, consent is assumed.
COPYRIGHT AND OWNERSHIP RIGHTS
The client may use the photographs only for personal purposes, unless otherwise specified in a contract.
The client is prohibited from further editing the photographs.
All photographs provided to the client remain the intellectual property of the photographer, and the client is not authorized to use them for commercial purposes or sell them to third parties without the photographer’s written consent.
